same company name, different state?
Hello, i’ve done some research on a new business i want to start. It’s a marketing and advertising firm, the name is Prestige Media or Prestige Media Group…but there is another one like that in Utah…and im in California…will i have any problems? i dont want to get sued… or go to court….
Dear,
There must be a department by the name of The Registrar of Companies (ROC) and The Registrar of Business for Enterprise (small business). If you want to open up a company and register at the Registrar of Companies or Enterprise with the Registrar of Business for Business not under a company. This will not allow if the name is existing. These goes through out the whole Country. These are the ruling in my country Malaysia. One name for a company and the company may have branches all over the country. It’s only Franchising been allow either from oversea such as Kentucky Fried Chicken, Mary Brown etc. etc., or Local in the country. You will be sue by the Registrar of company if you are opening a company or by the Registrar of Business if you are doing small business. If both Registrar are not aware, the company will report you to the Registrar and actions will be taken on you. You will go to court. I’m not sure about the Law in your country. This Law is practice in my country, Malaysia.

you might get sued but if you use your state name as in Prestige Media California you should be alright or even California Prestige Media. but its not the name of the company that makes it great, it is what the company does.
